National Vaccine Injury Compensation Program

About the Program
Although most people take vaccines with little or no side-effects, sometimes routine vaccinations result in serious injuries or death. The National Vaccine Injury Compensation Program was created by Congress to provide benefits to those who have suffered serious injury or death as a result of administration of certain vaccines. As of 2013, this program had made over $630,000,000 available to those who had suffered vaccine related injuries.
Covered vaccines include:
- Diphtheria
- Tetanus
- Pertussis
- Measles, Mumps, and Rubella
- Polio
- Hepatitis A
- Hepatitis B
- Haemophils Influenza (Hib)
- Varicella Vaccine (not shingles)
- Rotavirus
- Pneumococcal Conjugate
- Seasonal Influenza
- Human Papillomavirus (HPV)
- Meningococcal
Other vaccines may be covered as well. If you believe that you have a claim resulting from another vaccine you are welcome to contact our office for a consultation. The claims process will begin when we are able to evaluate the circumstances of your injury, including any relevant medical records or opinions. Claims can be brought on behalf of injured children (including newborns), as well as adults.
Bring Your Case to Our Columbia Personal Injury Attorney
When we accept a claim, we will assist in presenting it to the United States Court of Federal Claims. Attorney James R. Snell, Jr., has been admitted to practice before this court since 2010. Once the claim is submitted it will be assigned to a Special Mater to oversee the evaluations process. The “defendant” in these claims is not the vaccine maker or your doctor’s office, but instead is the United States Department of Health and Human Services. Attorney’s fees are paid by the government. So unlike traditional medical malpractice, or automobile accident cases, there is no contingency fee that is subtracted from a successful claim submission.
