Jail Guard Defense - Misconduct in Office

The lawyers at the Law Office of James R. Snell, Jr., LLC, have significant experience in representing employees of area detention centers or correctional facilities charged with misconduct in office, contraband offenses, sexual misconduct, or other criminal conduct.

Often times these situations not only result in an arrest, but are also reported by local news outlets (such as TV stations). This means that not only is our client's freedom at risk, but also their reputation and standing in the community.

Common situations we've seen jail or prison employees prosecuted for include:

  • Having a sexual or romantic relationship with an inmate
  • Communicating with an inmate outside of work hours
  • Bringing unauthorized food, cell phones, alcohol or drugs into the facility
  • Assisting inmates with committing other crimes, either inside or outside the facility
  • Failure to report sexual misconduct by other employees
  • Theft of government property

We represent clients whose cases were arrested by local law enforcement, or were referred to the South Carolina Law Enforcement Division (SLED). Cases can either be prosecuted by the local solicitor's office or the attorney general's office. These situations are serious, and employees charged with misconduct in office are facing up to 10 years in prison per offense. Additional charges for contraband, criminal conspiracy, or sexual offenses can also result in an additional sentence.

We are able to assist in cases throughout South Carolina, including the upstate, midlands, pee dee, and the low country. We are here to help fight for dismissals, or at our client's option entrance into pre-trial intervention (PTI) or favorable reductions or plea agreements.

If you're a current employee of a jail or correctional setting and are under investigation for any misconduct we can help you as well. Reaching out to a lawyer as soon as you've been accused or believe you are under investigation can help you minimize the chances of an arrest or conviction.
