Car accidents can be an extremely costly situation, which is why it is uncommon for some drivers to flee or leave the scene of the crash to avoid paying for another driver’s damages. However, committing a “hit and run” carries harsh criminal penalties if you are caught.
The following are the common types of hit-and-run charges in South Carolina and their associated penalties:
Leaving the scene of an accident resulting in roadside damage, such as a fence or mailbox – A misdemeanor that is punishable by a maximum jail sentence of 30 days and a fine of up to $100 (plus other costs).
Leaving the scene of an accident resulting in damage to unattended vehicles – A misdemeanor that carries a jail term of up to 30 days and a maximum fine of up to $100 (plus other costs).
Leaving the scene of an accident resulting in damage to attended vehicles – A misdemeanor that is punishable by a maximum jail sentence of one (1) year and a fine of up to $5,000.
Leaving the scene of an accident resulting in another person’s minor injury – A misdemeanor that is punishable by a jail sentence of up to one (1) year and a maximum fine of $5,000.
Leaving the scene of an accident resulting in another person’s serious injury – A felony that carries imprisonment for up to 10 years and a maximum fine of $10,000.
Leaving the scene of an accident resulting in another person’s death – A felony that is punishable by imprisonment for up to 25 years and a maximum fine of $25,000.
Remember, the only time it is acceptable to leave the scene of a crash is to seek assistance from law enforcement or any other emergency personnel. However, contacting emergency services over the phone is preferable.
In order to avoid a hit-and-run charge, you must stop your vehicle as soon as the collision occurs and remain on the scene until you obtain the other driver’s information and contact the authorities. If you struck an unattended vehicle or any other property, either find the owner of the vehicle or property and provide your information or leave your information on the vehicle or object.
