What Happens if I Am Hit by an Uninsured Driver?

If you are involved in an automobile accident caused by an uninsured driver this does not mean that you won't be able to recover for your injuries and damage to your vehicle.

Your own insurance policy likely contains uninsured motorist coverage. This insurance is designed to apply in cases where you are involved in an accident caused by an uninsured driver. Your insurance company will then step into the place of what should be the insurance company for the at-fault driver. You should know though that just because it is your insurance company does not mean that it will be any easier to settle your claim for a fair amount.

Another potential source of recovery will be from the personal assets of the driver themselves - or in certain cases the owner of the vehicle. If the at-fault driver has a house, property, or even a pending legal claim (like an estate) it may be possible to obtain compensation for your injury directly from them.

It is important that if you are involved in an accident with an uninsured driver you act as quickly as possible. There may be time limits shorter than the normal statute of limitations which will impact your right to collect.
