With the current foreclosure crisis, I am seeing more and more clients who are struggling with keeping their homes. Many times this situation is made all the worse by a serious injury, such as an automobile accident that keeps them out of work.

Unfortunately in all too many cases, the foreclosure situation is made all the more worse by the unlawful conduct of the banks and servicing companies. South Carolina is a judicial foreclosure state - this provides many important protections to South Carolina homeowners facing foreclosure.

Until a South Carolina Court signs an order of foreclosure or grants possession, it is against the law for a bank to trespass into your home, lock you out, take your property, or disconnect your utilities. When banks fail to follow the law they are subject to specific claims, including for conversion, forcible entry detainer, and trespass.
