Products Liability in a South Carolina Workers’ Compensation Claim

|
If you have been injured on the job in South Carolina you are entitled to pursue a Workers' Compensation claim. This is usually your only recourse against your employer and can help pay for medical bills, some lost wages, and permanent injury. Workers' Compensation does not pay for pain and suffering and your damages for any permanent injury or lost wages are capped.

If your work injury was caused by a piece of equipment you may have a separate claim against the manufacturer or distributor of the equipment in addition to your Workers' Compensation claim. Your claim regarding the equipment is called a product liability claim.

Product liability claims may arise as a result of improper labeling, inefficient safety equipment (such as safety guards that get in the way and have been removed), and electrical shorts.
