If you are arrested for
DUI in South Carolina the police may suspend your driver's license immediately for violation
of what is called our implied consent. This is violated if you either
cooperate with the breathalyzer and blow more than a 0.15 or if you refuse to blow.
Fortunately there are procedures in place to allow you to get your license
back in a matter of days. To do this you have to request a hearing within
thirty days. Once your hearing request is received the DMV will be automatically
notified and you can go to your local branch and pickup a new license.
At my office when I am retained in regards to a recent DUI arrest one
of the first things I do, typically the same day I am hired, is to submit
the hearing request for my client. If possible the hearing request should
be hand delivered to the hearing office in Columbia for faster processing.
If hand delivery isn't practical another option is overnight shipping
(such as UPS or Fed Ex) - these requests are typically opened and processed
before requests that come through the US Mail.
