What are the penalties for Felony DUI in South Carolina?

There are three separate types of DUI cases in South Carolina that are classified as felonies. They are:

Felony DUI with Death: This offense carries a minimum of one year to a maximum of twenty five years imprisonment.

Felony DUI with Great Bodily Injury: This offense carries a minimum of 30 days to a maximum of fifteen years imprisonment.

DUI 4th: This offense carries a minimum of one year to a maximum of seven years in prison.

These penalties are substantially higher than for a typical first offense misdemeanor DUI prosecuted in Traffic Court. All Felony DUI cases are prosecuted by the local Solicitor's office in General Sessions Court.
